2. General information
We treat your personal data confidentially and in accordance with statutory data protection rules (GDPR, German Federal Data Protection Act, German Telecommunications Digital Services Data Protection Act) and this privacy policy. You can use this website without actively providing personal data. Technically necessary data (such as your IP address) is, however, processed automatically when you open the site (see section 3).
3. Hosting (Netlify)
This website is hosted by Netlify, Inc. (San Francisco, USA). When you open the website, Netlify automatically processes data transmitted by your browser and stores it in server log files: IP address, date and time of access, page requested (URL), the previously visited page (referrer) and browser identification (user agent). This is necessary in order to deliver the website and to keep it secure and stable.
The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in providing our website securely and reliably. According to Netlify, server log files are stored for 30 days and then deleted.
Netlify acts as our processor; we have concluded a data processing agreement with Netlify pursuant to Art. 28 GDPR. As Netlify is based in the USA, data may be transferred to the USA. This transfer is based on the EU standard contractual clauses (Art. 46(2)(c) GDPR), which form part of that agreement. You may request a copy from us.
4. Contacting us
a) Contact form (Netlify Forms)
If you use our contact form, your details (name/company, email address, selected subject, message) and technical data relating to the transmission (such as IP address and time) are processed by our host Netlify, Inc. (San Francisco, USA), stored there and forwarded to us by email. We process this data in order to answer your enquiry.
To filter out automated spam, Netlify checks every submission using the Akismet service operated by Automattic Inc. (USA). The content of the submission and technical data are transmitted to Akismet for this purpose.
The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to entering into or performing a contract; otherwise Art. 6(1)(f) GDPR, our legitimate interest being to respond to enquiries addressed to us.
Netlify acts as our processor under a data processing agreement pursuant to Art. 28 GDPR; the transfer to the USA is based on the EU standard contractual clauses (Art. 46(2)(c) GDPR). You may request a copy from us.
We delete your enquiry, including in our Netlify account, once it has been dealt with conclusively. If your enquiry leads to a business relationship, we retain the correspondence for the statutory retention periods (generally six years for commercial and business letters under Section 257 of the German Commercial Code and Section 147 of the German Fiscal Code).
b) Email / telephone
If you contact us by email or telephone, we process your details in order to handle your enquiry and any follow-up questions. The legal basis and storage period correspond to section 4 a). We do not pass this data on to third parties without your consent.
5. Fonts (hosted locally)
This website uses web fonts that are stored on our own server. When the page is opened, the fonts are loaded directly from our host; no connection to third-party servers (such as Google) is established.
6. Cookie notice and storage of your choice
We store your choice in the cookie notice (consent or refusal) in your browser's local storage (entry “almiran_consent”) so that the notice does not reappear on every page view. This storage is strictly necessary in order to manage the consent you have expressed (Section 25(2) no. 2 TDDDG). No data is transmitted to us or to third parties in the process. You can change your choice at any time using the “Cookie settings” link in the footer of every page.
7. Google Analytics
If you have given your consent, we use Google Analytics 4, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Google Analytics is not loaded without your consent.
Purpose and data processed: We want to understand how visitors use our website in order to improve it. For this purpose, data such as pages viewed, time spent, the referring page, device and browser information and approximate location (country, region, city) is processed. The IP address is used only to derive the approximate location; according to Google, IP addresses are neither logged nor stored in Google Analytics 4.
Cookies: Google Analytics stores the cookies “_ga” and “_ga_<ID>” on your device, which allow your browser to be recognised on later visits. These cookies have a lifetime of up to two years.
Legal basis: Storing and reading the cookies is based on your consent under Section 25(1) TDDDG; the subsequent processing of your data is based on your consent under Art. 6(1)(a) GDPR.
Recipients and transfer to the USA: Google processes the data as our processor; we have accepted Google's data processing terms pursuant to Art. 28 GDPR. Data may be transferred to Google LLC in the USA. Google LLC is certified under the EU-US Data Privacy Framework; for such transfers the European Commission's adequacy decision of 10 July 2023 applies (Art. 45 GDPR).
Storage period: Analytics data is deleted automatically by Google after two months. Google Signals (linking to Google accounts) is switched off.
Withdrawal: You can withdraw your consent at any time with effect for the future: click “Cookie settings” in the footer and then “Ablehnen” (decline). The Google Analytics cookies are deleted in the process. The lawfulness of processing carried out before the withdrawal remains unaffected.
Further information is available in Google's privacy policy: policies.google.com/privacy.
8. SSL/TLS encryption
For security reasons this site uses SSL/TLS encryption. You can recognise an encrypted connection by the “https://” in your browser's address bar.
9. Storage period
Unless a more specific storage period is stated in this privacy policy, your personal data remains with us until the purpose of processing ceases to apply or statutory retention periods expire.
10. Obligation to provide data, automated decisions
You are under no statutory or contractual obligation to provide us with personal data. However, without the technically necessary data (section 3) the website cannot be displayed, and without the details requested in the contact form (name/company, email address, message) we cannot answer your enquiry.
Automated decision-making, including profiling, within the meaning of Art. 22 GDPR does not take place.
11. Your rights
You have the right at any time to:
- obtain information about the data we store about you (Art. 15 GDPR),
- have inaccurate data corrected (Art. 16 GDPR),
- have data erased (Art. 17 GDPR) and to restrict processing (Art. 18 GDPR),
- data portability (Art. 20 GDPR),
- object to processing (Art. 21 GDPR – see the separate notice below),
- withdraw any consent given, with effect for the future (Art. 7(3) GDPR).
You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (LDI NRW), Kavalleriestr. 2–4, 40213 Düsseldorf, Germany.
Information about your right to object under Art. 21 GDPR
Where we process your personal data on the basis of Art. 6(1)(f) GDPR (legitimate interest) – in particular for hosting (server log files) and for answering enquiries – you have the right to object to that processing at any time on grounds relating to your particular situation.
We will then no longer process your data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims. No particular form is required; an email to info@almirangruppe.de is sufficient.
If you have any questions about data protection, please contact: info@almirangruppe.de
